Introduction
Welcome to Boondok! These Terms of Service ("Terms") govern your access to and use of the Boondok campsite availability alert service, including our website at boondok.app and any related services (collectively, the "Service").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.
Important: These Terms contain an arbitration clause and class action waiver that affect your legal rights. Please read the "Dispute Resolution" section carefully.
About Boondok
Boondok Inc. ("Boondok," "we," "us," or "our") is a Canadian company that provides campsite availability alerts for campgrounds in British Columbia, Alberta, and other Canadian provinces. We monitor campground availability and notify you when sites matching your preferences become available.
What We Are
- An alert and notification service (currently in early access)
What We Are Not
- We are not a booking service or reservation platform
- We do not guarantee campsite availability
- We are not affiliated with provincial parks or campground operators
- We do not control campground booking systems or policies
Eligibility
You must meet the following requirements to use our Service:
- You must be at least 13 years of age to use our Service
- You must provide accurate and complete registration information
- You must have the legal capacity to enter into these Terms
- You must not be prohibited from using the Service under Canadian law
- You must reside in a jurisdiction where our Service is available
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Account Registration and Security
Creating an Account
To use most features of our Service, you must create an account through our authentication provider (Auth0) by providing:
- A valid email address
- Your name
- A phone number (optional, for future notifications)
Your Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your contact information is accurate and up to date
- Not sharing your account with others or creating multiple accounts
Account security features, including multi-factor authentication, are managed through our authentication provider.
Account Verification
We require email verification before you can activate alerts. We may require additional verification for security or fraud prevention purposes.
Service Features and Limitations
Current Features
Our Service is currently in an invite-only early access phase. During this phase, the Service allows you to:
- Create an account and manage your profile
- Sign up for early access to be notified when new features launch
Important Limitations
You understand and agree that:
- Alerts are not instant. We check availability periodically. There may be delays between when a site becomes available and when you receive an alert.
- Availability changes rapidly. A site may be booked by the time you receive our alert and attempt to book it.
- We do not guarantee accuracy. While we strive for accuracy, campground data may be incorrect, incomplete, or outdated.
- Service coverage varies. We do not monitor all campgrounds. Coverage depends on data availability and technical feasibility.
- We may experience downtime. Our Service may be interrupted due to maintenance, technical issues, or circumstances beyond our control.
Acceptable Use Policy
Permitted Use
You may use our Service for personal, non-commercial purposes to:
- Find and monitor campsite availability
- Receive notifications about available campsites
- Plan camping trips
- Explore campground information
Prohibited Conduct
You may not:
Abuse or Misuse
- Create excessive or fraudulent alerts
- Use the Service to harass, spam, or send unsolicited messages
- Share your account with others or create multiple accounts
- Use automated tools (bots, scrapers, crawlers) to access the Service or scrape our website, API, or data
- Attempt to extract, copy, or download campground data or availability information in bulk
- Reverse engineer, decompile, or attempt to extract our source code
Circumvent Restrictions
- Bypass rate limits or usage restrictions
- Attempt to access features not included in your plan
- Interfere with security features or authentication systems
- Use VPNs or proxies to evade bans or restrictions
Harm Our Service or Others
- Overload or interfere with our infrastructure
- Introduce viruses, malware, or harmful code
- Violate the terms of service of campground booking systems
- Resell or redistribute our Service without authorization
- Use the Service for any illegal purpose
Misrepresent or Deceive
- Provide false or misleading information
- Impersonate others or misrepresent your affiliation
- Post or transmit defamatory or fraudulent content
Consequences of Violations
If you violate these Terms, we may:
- Issue a warning
- Temporarily suspend your account
- Permanently terminate your account
- Withhold refunds for paid services
- Take legal action if necessary
- Report illegal activity to law enforcement
Intellectual Property Rights
Our Intellectual Property
All content, features, and functionality of the Service, including but not limited to:
- Software, code, and algorithms
- Website design, logos, and branding
- Text, graphics, images, and user interface
- Campground data compilations and availability information
- Trademarks and service marks
are owned by Boondok or our licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
Your License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Service for your personal use in accordance with these Terms. This license does not include:
- Commercial use or resale
- Derivative works or modifications
- Public display or distribution
- Removal of copyright or proprietary notices
Feedback and Suggestions
If you provide feedback, suggestions, or ideas about our Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.
Third-Party Services and Links
Campground Booking Sites
Our Service provides links to third-party campground booking and reservation systems operated by provincial parks, private campgrounds, and other entities. We are not responsible for:
- The availability, accuracy, or reliability of these sites
- Their booking processes, fees, or cancellation policies
- Technical issues or errors on their systems
- Privacy practices or data handling
Your use of third-party booking sites is subject to their own terms and conditions.
Service Providers
We use third-party service providers to operate our Service, including:
- Auth0 (authentication)
- Amazon Web Services (hosting and email delivery)
Your use of our Service is subject to the terms of these providers as they relate to our use of their services.
Electronic Communications Compliance (CASL)
In compliance with Canada's Anti-Spam Legislation (CASL), by providing your email address, you consent to receive electronic communications from us, including:
- Service-related notifications
- Important service updates
- Early access and account information
You may withdraw your consent at any time by:
- Unsubscribing from marketing emails via the unsubscribe link

Important: Withdrawing consent for essential communications (e.g., account security alerts) may affect our ability to provide certain services.
No Endorsement
Links to third-party websites do not imply endorsement. We are not responsible for third-party content, products, or services.
Data Collection and Privacy
Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Service, you consent to our data practices as described in the Privacy Policy.

Service Provided "As Is"
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Accuracy, reliability, or completeness of campground data
- Timeliness or delivery of alerts and notifications
- Uninterrupted or error-free operation
- Security or absence of viruses or harmful components
- Fitness for a particular purpose or merchantability
We make no guarantees that:
- You will receive alerts before sites are booked
- Availability information is current or accurate
- You will be able to successfully book a campsite
- Our Service will meet your expectations
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOONDOK, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
Direct Damages
- Missed camping opportunities or reservations
- Costs incurred from inaccurate information
- Failed notifications or alert delays
Indirect Damages
- Lost profits, revenue, or business opportunities
- Data loss or corruption
- Cost of substitute services
- Consequential, incidental, special, or punitive damages
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 CAD, WHICHEVER IS GREATER.
Exceptions
Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
These limitations do not apply to:
- Liability for death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded by law
Indemnification
You agree to indemnify, defend, and hold harmless Boondok, its affiliates, and their respective directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of others
- Your violation of applicable laws or regulations
- Content you submit or transmit through the Service
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, at your expense.
Termination
Your Right to Terminate
You may terminate your account at any time by:
- Deleting your account through account settings
- Contacting us at support@boondok.app
Upon termination:
- Your access to the Service will end immediately
- Your personal data will be deleted in accordance with our Privacy Policy
Our Right to Terminate
We may suspend or terminate your account immediately, without notice, if:
- You violate these Terms or our policies
- We suspect fraudulent, abusive, or illegal activity
- Your account is inactive for an extended period
- We cease operations or discontinue the Service
- Required by law or legal process
We will provide notice when reasonably possible, except where immediate termination is necessary for legal or security reasons.
Effect of Termination
Upon termination:
- All licenses granted to you terminate immediately
- You must cease all use of the Service
- Sections that by their nature should survive will remain in effect
Changes to These Terms
We may modify these Terms from time to time. When we make changes:
Notice of Changes
- We will post the updated Terms on our website
- We will update the "Last Updated" date
- We will send email notification for material changes
- Changes become effective 30 days after notice (or immediately for legal requirements)
Your Options
- Continued use of the Service after changes take effect constitutes acceptance
- If you do not agree to changes, you must stop using the Service and delete your account
- Cancelling due to Terms changes does not entitle you to a refund
Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Informal Resolution
Before initiating any formal proceedings, you agree to contact us at legal@boondok.app to seek an informal resolution. We will attempt to resolve disputes through good faith negotiation.
Arbitration Agreement
Binding Arbitration If we cannot resolve a dispute informally within 60 days, you agree that the dispute will be resolved by binding arbitration under the rules of the British Columbia International Commercial Arbitration Centre (BCICAC), except as modified by these Terms.
Arbitration Process
- Arbitration will be conducted in English
- Arbitration location will be Vancouver, British Columbia, or remote via videoconference
- Each party bears their own costs and fees
- The arbitrator's decision is final and binding
- Judgment on the award may be entered in any court of competent jurisdiction
Exceptions to Arbitration You or we may bring claims in small claims court if they qualify. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.
Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, REPRESENTATIVE ACTION, OR CONSOLIDATED PROCEEDING AGAINST BOONDOK.
Time Limit for Claims
Any claim or dispute must be filed within one year after the claim arises, or it will be permanently barred.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Boondok regarding the Service and supersede all prior agreements.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver
Our failure to enforce any provision does not waive our right to enforce it later. Any waiver must be in writing and signed by us.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.
Force Majeure
We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including:
- Natural disasters or extreme weather
- Acts of government or authorities
- Strikes, labor disputes, or shortages
- Internet or telecommunications failures
- Actions or omissions of third parties
- Pandemics or public health emergencies
Notices
We may provide notices to you:
- By email to your registered email address
- By posting on our website or in your account dashboard
- By SMS to your registered phone number
You must provide notices to us by email at legal@boondok.app.
Language
These Terms are written in English. Any translations are provided for convenience only. In the event of conflict, the English version prevails.
Relationship
These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Boondok.
Accessibility
Boondok is committed to ensuring our Service is accessible to all users. We strive to comply with accessibility standards and guidelines, including the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA where feasible. If you encounter any accessibility barriers or have suggestions for improvement, please contact us at support@boondok.app.
British Columbia Consumer Protection
As a service operating in British Columbia, we comply with the British Columbia Consumer Protection Act. If you are a BC consumer, you have additional rights under this legislation, including:
- The right to clear and honest information about our services
- Protection against unfair business practices
- The right to cancel certain subscriptions within the cooling-off period (as described in the "Cancellation and Refunds" section)
- The right to file a complaint with Consumer Protection BC if you believe we have violated your consumer rights
